\r
37 <p>Simantics Platform is licensed under <a href="#Eclipse_Public_License">Eclipse Public License</a>.
\r
38 The license does not have to apply to 3rd party applications and
\r
39 plug-ins that are integrated with Simantics. That means, an application
\r
40 built on Simantics can be e.g. a commercial, closed code. Or it can be
\r
41 an open source product. In any case, the application and plug-in
\r
42 licensing have to respect Simantics licensing. E.g. if a plug-in
\r
43 component uses a so-called "Strict GPL", the integration with Simantics
\r
44 has to be done with extra care; the GPL licensed software can't
\r
45 influence the licensing of Simantics platform. For commercial products,
\r
46 the application or plug-in has to be clearly separated from the platform
\r
47 and all the integration code needed in the Simantics platform side has
\r
48 to be licensed under Eclipse Public License (EPL).
\r
49 </p><p>On <a rel="nofollow" class="external text" href="http://www.gnu.org/philosophy/license-list.html">GNU Operating System</a>
\r
50 website there is an excellent description of different free and open
\r
51 source licenses and their differences in a nut shell. Another website
\r
52 worth mentioning is <a rel="nofollow" class="external text" href="http://www.opensource.org/">Open Source Initiative</a>. From this side you can find information about open source software development and licensing.
\r
53 </p><p>Simantics depends on a few third party components which have license other than EPL.

590 TERMS AND CONDITIONS FOR USE, REPRODUCTION, AND DISTRIBUTION
\r
594 "License" shall mean the terms and conditions for use, reproduction,
\r
595 and distribution as defined by Sections 1 through 9 of this document.
\r
597 "Licensor" shall mean the copyright owner or entity authorized by
\r
598 the copyright owner that is granting the License.
\r
600 "Legal Entity" shall mean the union of the acting entity and all
\r
601 other entities that control, are controlled by, or are under common
\r
602 control with that entity. For the purposes of this definition,
\r
603 "control" means (i) the power, direct or indirect, to cause the
\r
604 direction or management of such entity, whether by contract or
\r
605 otherwise, or (ii) ownership of fifty percent (50%) or more of the
\r
606 outstanding shares, or (iii) beneficial ownership of such entity.
\r
608 "You" (or "Your") shall mean an individual or Legal Entity
\r
609 exercising permissions granted by this License.
\r
611 "Source" form shall mean the preferred form for making modifications,
\r
612 including but not limited to software source code, documentation
\r
613 source, and configuration files.
\r
615 "Object" form shall mean any form resulting from mechanical
\r
616 transformation or translation of a Source form, including but
\r
617 not limited to compiled object code, generated documentation,
\r
618 and conversions to other media types.
\r
620 "Work" shall mean the work of authorship, whether in Source or
\r
621 Object form, made available under the License, as indicated by a
\r
622 copyright notice that is included in or attached to the work
\r
623 (an example is provided in the Appendix below).
\r
625 "Derivative Works" shall mean any work, whether in Source or Object
\r
626 form, that is based on (or derived from) the Work and for which the
\r
627 editorial revisions, annotations, elaborations, or other modifications
\r
628 represent, as a whole, an original work of authorship. For the purposes
\r
629 of this License, Derivative Works shall not include works that remain
\r
630 separable from, or merely link (or bind by name) to the interfaces of,
\r
631 the Work and Derivative Works thereof.
\r
633 "Contribution" shall mean any work of authorship, including
\r
634 the original version of the Work and any modifications or additions
\r
635 to that Work or Derivative Works thereof, that is intentionally
\r
636 submitted to Licensor for inclusion in the Work by the copyright owner
\r
637 or by an individual or Legal Entity authorized to submit on behalf of
\r
638 the copyright owner. For the purposes of this definition, "submitted"
\r
639 means any form of electronic, verbal, or written communication sent
\r
640 to the Licensor or its representatives, including but not limited to
\r
641 communication on electronic mailing lists, source code control systems,
\r
642 and issue tracking systems that are managed by, or on behalf of, the
\r
643 Licensor for the purpose of discussing and improving the Work, but
\r
644 excluding communication that is conspicuously marked or otherwise
\r
645 designated in writing by the copyright owner as "Not a Contribution."
\r
647 "Contributor" shall mean Licensor and any individual or Legal Entity
\r
648 on behalf of whom a Contribution has been received by Licensor and
\r
649 subsequently incorporated within the Work.
\r
651 2. Grant of Copyright License. Subject to the terms and conditions of
\r
652 this License, each Contributor hereby grants to You a perpetual,
\r
653 worldwide, non-exclusive, no-charge, royalty-free, irrevocable
\r
654 copyright license to reproduce, prepare Derivative Works of,
\r
655 publicly display, publicly perform, sublicense, and distribute the
\r
656 Work and such Derivative Works in Source or Object form.
\r
658 3. Grant of Patent License. Subject to the terms and conditions of
\r
659 this License, each Contributor hereby grants to You a perpetual,
\r
660 worldwide, non-exclusive, no-charge, royalty-free, irrevocable
\r
661 (except as stated in this section) patent license to make, have made,
\r
662 use, offer to sell, sell, import, and otherwise transfer the Work,
\r
663 where such license applies only to those patent claims licensable
\r
664 by such Contributor that are necessarily infringed by their
\r
665 Contribution(s) alone or by combination of their Contribution(s)
\r
666 with the Work to which such Contribution(s) was submitted. If You
\r
667 institute patent litigation against any entity (including a
\r
668 cross-claim or counterclaim in a lawsuit) alleging that the Work
\r
669 or a Contribution incorporated within the Work constitutes direct
\r
670 or contributory patent infringement, then any patent licenses
\r
671 granted to You under this License for that Work shall terminate
\r
672 as of the date such litigation is filed.
\r
674 4. Redistribution. You may reproduce and distribute copies of the
\r
675 Work or Derivative Works thereof in any medium, with or without
\r
676 modifications, and in Source or Object form, provided that You
\r
677 meet the following conditions:
\r
679 (a) You must give any other recipients of the Work or
\r
680 Derivative Works a copy of this License; and
\r
682 (b) You must cause any modified files to carry prominent notices
\r
683 stating that You changed the files; and
\r
685 (c) You must retain, in the Source form of any Derivative Works
\r
686 that You distribute, all copyright, patent, trademark, and
\r
687 attribution notices from the Source form of the Work,
\r
688 excluding those notices that do not pertain to any part of
\r
689 the Derivative Works; and
\r
691 (d) If the Work includes a "NOTICE" text file as part of its
\r
692 distribution, then any Derivative Works that You distribute must
\r
693 include a readable copy of the attribution notices contained
\r
694 within such NOTICE file, excluding those notices that do not
\r
695 pertain to any part of the Derivative Works, in at least one
\r
696 of the following places: within a NOTICE text file distributed
\r
697 as part of the Derivative Works; within the Source form or
\r
698 documentation, if provided along with the Derivative Works; or,
\r
699 within a display generated by the Derivative Works, if and
\r
700 wherever such third-party notices normally appear. The contents
\r
701 of the NOTICE file are for informational purposes only and
\r
702 do not modify the License. You may add Your own attribution
\r
703 notices within Derivative Works that You distribute, alongside
\r
704 or as an addendum to the NOTICE text from the Work, provided
\r
705 that such additional attribution notices cannot be construed
\r
706 as modifying the License.
\r
708 You may add Your own copyright statement to Your modifications and
\r
709 may provide additional or different license terms and conditions
\r
710 for use, reproduction, or distribution of Your modifications, or
\r
711 for any such Derivative Works as a whole, provided Your use,
\r
712 reproduction, and distribution of the Work otherwise complies with
\r
713 the conditions stated in this License.
\r
715 5. Submission of Contributions. Unless You explicitly state otherwise,
\r
716 any Contribution intentionally submitted for inclusion in the Work
\r
717 by You to the Licensor shall be under the terms and conditions of
\r
718 this License, without any additional terms or conditions.
\r
719 Notwithstanding the above, nothing herein shall supersede or modify
\r
720 the terms of any separate license agreement you may have executed
\r
721 with Licensor regarding such Contributions.
\r
723 6. Trademarks. This License does not grant permission to use the trade
\r
724 names, trademarks, service marks, or product names of the Licensor,
\r
725 except as required for reasonable and customary use in describing the
\r
726 origin of the Work and reproducing the content of the NOTICE file.
\r
728 7. Disclaimer of Warranty. Unless required by applicable law or
\r
729 agreed to in writing, Licensor provides the Work (and each
\r
730 Contributor provides its Contributions) on an "AS IS" BASIS,
\r
731 WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, either express or
\r
732 implied, including, without limitation, any warranties or conditions
\r
733 of TITLE, NON-INFRINGEMENT, MERCHANTABILITY, or FITNESS FOR A
\r
734 PARTICULAR PURPOSE. You are solely responsible for determining the
\r
735 appropriateness of using or redistributing the Work and assume any
\r
736 risks associated with Your exercise of permissions under this License.
\r
738 8. Limitation of Liability. In no event and under no legal theory,
\r
739 whether in tort (including negligence), contract, or otherwise,
\r
740 unless required by applicable law (such as deliberate and grossly
\r
741 negligent acts) or agreed to in writing, shall any Contributor be
\r
742 liable to You for damages, including any direct, indirect, special,
\r
743 incidental, or consequential damages of any character arising as a
\r
744 result of this License or out of the use or inability to use the
\r
745 Work (including but not limited to damages for loss of goodwill,
\r
746 work stoppage, computer failure or malfunction, or any and all
\r
747 other commercial damages or losses), even if such Contributor
\r
748 has been advised of the possibility of such damages.
\r
750 9. Accepting Warranty or Additional Liability. While redistributing
\r
751 the Work or Derivative Works thereof, You may choose to offer,
\r
752 and charge a fee for, acceptance of support, warranty, indemnity,
\r
753 or other liability obligations and/or rights consistent with this
\r
754 License. However, in accepting such obligations, You may act only
\r
755 on Your own behalf and on Your sole responsibility, not on behalf
\r
756 of any other Contributor, and only if You agree to indemnify,
\r
757 defend, and hold each Contributor harmless for any liability
\r
758 incurred by, or claims asserted against, such Contributor by reason
\r
759 of your accepting any such warranty or additional liability.
\r
761 END OF TERMS AND CONDITIONS

\r
1010 the date Initial Developer first distributes or otherwise makes the
\r
1011 Original Software available to a third party under the terms of this
\r
1014 (d) Notwithstanding Section 2.1(b) above, no patent license is
\r
1015 granted: (1) for code that You delete from the Original Software, or
\r
1016 (2) for infringements caused by: (i) the modification of the
\r
1017 Original Software, or (ii) the combination of the Original Software
\r
1018 with other software or devices.
\r
1020 2.2. Contributor Grant.
\r
1022 Conditioned upon Your compliance with Section 3.1 below and subject
\r
1023 to third party intellectual property claims, each Contributor hereby
\r
1024 grants You a world-wide, royalty-free, non-exclusive license:
\r
1026 (a) under intellectual property rights (other than patent or
\r
1027 trademark) Licensable by Contributor to use, reproduce, modify,
\r
1028 display, perform, sublicense and distribute the Modifications
\r
1029 created by such Contributor (or portions thereof), either on an
\r
1030 unmodified basis, with other Modifications, as Covered Software
\r
1031 and/or as part of a Larger Work; and
\r
1033 (b) under Patent Claims infringed by the making, using, or selling
\r
1034 of Modifications made by that Contributor either alone and/or in
\r
1035 combination with its Contributor Version (or portions of such
\r
1036 combination), to make, use, sell, offer for sale, have made, and/or
\r
1037 otherwise dispose of: (1) Modifications made by that Contributor (or
\r
1038 portions thereof); and (2) the combination of Modifications made by
\r
1039 that Contributor with its Contributor Version (or portions of such
\r
1042 (c) The licenses granted in Sections 2.2(a) and 2.2(b) are effective
\r
1043 on the date Contributor first distributes or otherwise makes the
\r
1044 Modifications available to a third party.
\r
1046 (d) Notwithstanding Section 2.2(b) above, no patent license is
\r
1047 granted: (1) for any code that Contributor has deleted from the
\r
1048 Contributor Version; (2) for infringements caused by: (i) third
\r
1049 party modifications of Contributor Version, or (ii) the combination
\r
1050 of Modifications made by that Contributor with other software
\r
1051 (except as part of the Contributor Version) or other devices; or (3)
\r
1052 under Patent Claims infringed by Covered Software in the absence of
\r
1053 Modifications made by that Contributor.
\r
1055 3. Distribution Obligations.
\r
1057 3.1. Availability of Source Code.
\r
1059 Any Covered Software that You distribute or otherwise make available
\r
1060 in Executable form must also be made available in Source Code form
\r
1061 and that Source Code form must be distributed only under the terms
\r
1062 of this License. You must include a copy of this License with every
\r
1063 copy of the Source Code form of the Covered Software You distribute
\r
1064 or otherwise make available. You must inform recipients of any such
\r
1065 Covered Software in Executable form as to how they can obtain such
\r
1066 Covered Software in Source Code form in a reasonable manner on or
\r
1067 through a medium customarily used for software exchange.
\r
1069 3.2. Modifications.
\r
1071 The Modifications that You create or to which You contribute are
\r
1072 governed by the terms of this License. You represent that You
\r
1073 believe Your Modifications are Your original creation(s) and/or You
\r
1074 have sufficient rights to grant the rights conveyed by this License.
\r
1076 3.3. Required Notices.
\r
1078 You must include a notice in each of Your Modifications that
\r
1079 identifies You as the Contributor of the Modification. You may not
\r
1080 remove or alter any copyright, patent or trademark notices contained
\r
1081 within the Covered Software, or any notices of licensing or any
\r
1082 descriptive text giving attribution to any Contributor or the
\r
1083 Initial Developer.
\r
1085 3.4. Application of Additional Terms.
\r
1087 You may not offer or impose any terms on any Covered Software in
\r
1088 Source Code form that alters or restricts the applicable version of
\r
1089 this License or the recipients' rights hereunder. You may choose to
\r
1090 offer, and to charge a fee for, warranty, support, indemnity or
\r
1091 liability obligations to one or more recipients of Covered Software.
\r
1092 However, you may do so only on Your own behalf, and not on behalf of
\r
1093 the Initial Developer or any Contributor. You must make it
\r
1094 absolutely clear that any such warranty, support, indemnity or
\r
1095 liability obligation is offered by You alone, and You hereby agree
\r
1096 to indemnify the Initial Developer and every Contributor for any
\r
1097 liability incurred by the Initial Developer or such Contributor as a
\r
1098 result of warranty, support, indemnity or liability terms You offer.
\r
1100 3.5. Distribution of Executable Versions.
\r
1102 You may distribute the Executable form of the Covered Software under
\r
1103 the terms of this License or under the terms of a license of Your
\r
1104 choice, which may contain terms different from this License,
\r
1105 provided that You are in compliance with the terms of this License
\r
1106 and that the license for the Executable form does not attempt to
\r
1107 limit or alter the recipient's rights in the Source Code form from
\r
1108 the rights set forth in this License. If You distribute the Covered
\r
1109 Software in Executable form under a different license, You must make
\r
1110 it absolutely clear that any terms which differ from this License
\r
1111 are offered by You alone, not by the Initial Developer or
\r
1112 Contributor. You hereby agree to indemnify the Initial Developer and
\r
1113 every Contributor for any liability incurred by the Initial
\r
1114 Developer or such Contributor as a result of any such terms You offer.
\r
1116 3.6. Larger Works.
\r
1118 You may create a Larger Work by combining Covered Software with
\r
1119 other code not governed by the terms of this License and distribute
\r
1120 the Larger Work as a single product. In such a case, You must make
\r
1121 sure the requirements of this License are fulfilled for the Covered
\r
1124 4. Versions of the License.
\r
1126 4.1. New Versions.
\r
1128 Oracle is the initial license steward and may publish revised and/or
\r
1129 new versions of this License from time to time. Each version will be
\r
1130 given a distinguishing version number. Except as provided in Section
\r
1131 4.3, no one other than the license steward has the right to modify
\r
1134 4.2. Effect of New Versions.
\r
1136 You may always continue to use, distribute or otherwise make the
\r
1137 Covered Software available under the terms of the version of the
\r
1138 License under which You originally received the Covered Software. If
\r
1139 the Initial Developer includes a notice in the Original Software
\r
1140 prohibiting it from being distributed or otherwise made available
\r
1141 under any subsequent version of the License, You must distribute and
\r
1142 make the Covered Software available under the terms of the version
\r
1143 of the License under which You originally received the Covered
\r
1144 Software. Otherwise, You may also choose to use, distribute or
\r
1145 otherwise make the Covered Software available under the terms of any
\r
1146 subsequent version of the License published by the license steward.
\r
1148 4.3. Modified Versions.
\r
1150 When You are an Initial Developer and You want to create a new
\r
1151 license for Your Original Software, You may create and use a
\r
1152 modified version of this License if You: (a) rename the license and
\r
1153 remove any references to the name of the license steward (except to
\r
1154 note that the license differs from this License); and (b) otherwise
\r
1155 make it clear that the license contains terms which differ from this
\r
1158 5. DISCLAIMER OF WARRANTY.
\r
1160 COVERED SOFTWARE IS PROVIDED UNDER THIS LICENSE ON AN "AS IS" BASIS,
\r
1161 WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED,
\r
1162 INCLUDING, WITHOUT LIMITATION, WARRANTIES THAT THE COVERED SOFTWARE
\r
1163 IS FREE OF DEFECTS, MERCHANTABLE, FIT FOR A PARTICULAR PURPOSE OR
\r
1164 NON-INFRINGING. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF
\r
1165 THE COVERED SOFTWARE IS WITH YOU. SHOULD ANY COVERED SOFTWARE PROVE
\r
1166 DEFECTIVE IN ANY RESPECT, YOU (NOT THE INITIAL DEVELOPER OR ANY
\r
1167 OTHER CONTRIBUTOR) ASSUME THE COST OF ANY NECESSARY SERVICING,
\r
1168 REPAIR OR CORRECTION. THIS DISCLAIMER OF WARRANTY CONSTITUTES AN
\r
1169 ESSENTIAL PART OF THIS LICENSE. NO USE OF ANY COVERED SOFTWARE IS
\r
1170 AUTHORIZED HEREUNDER EXCEPT UNDER THIS DISCLAIMER.
\r
1174 6.1. This License and the rights granted hereunder will terminate
\r
1175 automatically if You fail to comply with terms herein and fail to
\r
1176 cure such breach within 30 days of becoming aware of the breach.
\r
1177 Provisions which, by their nature, must remain in effect beyond the
\r
1178 termination of this License shall survive.
\r
1180 6.2. If You assert a patent infringement claim (excluding
\r
1181 declaratory judgment actions) against Initial Developer or a
\r
1182 Contributor (the Initial Developer or Contributor against whom You
\r
1183 assert such claim is referred to as "Participant") alleging that the
\r
1184 Participant Software (meaning the Contributor Version where the
\r
1185 Participant is a Contributor or the Original Software where the
\r
1186 Participant is the Initial Developer) directly or indirectly
\r
1187 infringes any patent, then any and all rights granted directly or
\r
1188 indirectly to You by such Participant, the Initial Developer (if the
\r
1189 Initial Developer is not the Participant) and all Contributors under
\r
1190 Sections 2.1 and/or 2.2 of this License shall, upon 60 days notice
\r
1191 from Participant terminate prospectively and automatically at the
\r
1192 expiration of such 60 day notice period, unless if within such 60
\r
1193 day period You withdraw Your claim with respect to the Participant
\r
1194 Software against such Participant either unilaterally or pursuant to
\r
1195 a written agreement with Participant.
\r
1197 6.3. If You assert a patent infringement claim against Participant
\r
1198 alleging that the Participant Software directly or indirectly
\r
1199 infringes any patent where such claim is resolved (such as by
\r
1200 license or settlement) prior to the initiation of patent
\r
1201 infringement litigation, then the reasonable value of the licenses
\r
1202 granted by such Participant under Sections 2.1 or 2.2 shall be taken
\r
1203 into account in determining the amount or value of any payment or
\r
1206 6.4. In the event of termination under Sections 6.1 or 6.2 above,
\r
1207 all end user licenses that have been validly granted by You or any
\r
1208 distributor hereunder prior to termination (excluding licenses
\r
1209 granted to You by any distributor) shall survive termination.
\r
1211 7. LIMITATION OF LIABILITY.
\r
1213 UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER TORT
\r
1214 (INCLUDING NEGLIGENCE), CONTRACT, OR OTHERWISE, SHALL YOU, THE
\r
1215 INITIAL DEVELOPER, ANY OTHER CONTRIBUTOR, OR ANY DISTRIBUTOR OF
\r
1216 COVERED SOFTWARE, OR ANY SUPPLIER OF ANY OF SUCH PARTIES, BE LIABLE
\r
1217 TO ANY PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR
\r
1218 CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT
\r
1219 LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER
\r
1220 FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR
\r
1221 LOSSES, EVEN IF SUCH PARTY SHALL HAVE BEEN INFORMED OF THE
\r
1222 POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION OF LIABILITY SHALL NOT
\r
1223 APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM SUCH
\r
1224 PARTY'S NEGLIGENCE TO THE EXTENT APPLICABLE LAW PROHIBITS SUCH
\r
1225 LIMITATION. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR
\r
1226 LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS EXCLUSION
\r
1227 AND LIMITATION MAY NOT APPLY TO YOU.
\r
1229 8. U.S. GOVERNMENT END USERS.
\r
1231 The Covered Software is a "commercial item," as that term is defined
\r
1232 in 48 C.F.R. 2.101 (Oct. 1995), consisting of "commercial computer
\r
1233 software" (as that term is defined at 48 C.F.R. ß
\r
1234 252.227-7014(a)(1)) and "commercial computer software documentation"
\r
1235 as such terms are used in 48 C.F.R. 12.212 (Sept. 1995). Consistent
\r
1236 with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 227.7202-4
\r
1237 (June 1995), all U.S. Government End Users acquire Covered Software
\r
1238 with only those rights set forth herein. This U.S. Government Rights
\r
1239 clause is in lieu of, and supersedes, any other FAR, DFAR, or other
\r
1240 clause or provision that addresses Government rights in computer
\r
1241 software under this License.
\r
1245 This License represents the complete agreement concerning subject
\r
1246 matter hereof. If any provision of this License is held to be
\r
1247 unenforceable, such provision shall be reformed only to the extent
\r
1248 necessary to make it enforceable. This License shall be governed by
\r
1249 the law of the jurisdiction specified in a notice contained within
\r
1250 the Original Software (except to the extent applicable law, if any,
\r
1251 provides otherwise), excluding such jurisdiction's conflict-of-law
\r
1252 provisions. Any litigation relating to this License shall be subject
\r
1253 to the jurisdiction of the courts located in the jurisdiction and
\r
1254 venue specified in a notice contained within the Original Software,
\r
1255 with the losing party responsible for costs, including, without
\r
1256 limitation, court costs and reasonable attorneys' fees and expenses.
\r
1257 The application of the United Nations Convention on Contracts for
\r
1258 the International Sale of Goods is expressly excluded. Any law or
\r
1259 regulation which provides that the language of a contract shall be
\r
1260 construed against the drafter shall not apply to this License. You
\r
1261 agree that You alone are responsible for compliance with the United
\r
1262 States export administration regulations (and the export control
\r
1263 laws and regulation of any other countries) when You use, distribute
\r
1264 or otherwise make available any Covered Software.
\r
1266 10. RESPONSIBILITY FOR CLAIMS.
\r
1268 As between Initial Developer and the Contributors, each party is
\r
1269 responsible for claims and damages arising, directly or indirectly,
\r
1270 out of its utilization of rights under this License and You agree to
\r
1271 work with Initial Developer and Contributors to distribute such
\r
1272 responsibility on an equitable basis. Nothing herein is intended or
\r
1273 shall be deemed to constitute any admission of liability.
\r
1275 ------------------------------------------------------------------------
\r
1277 NOTICE PURSUANT TO SECTION 9 OF THE COMMON DEVELOPMENT AND DISTRIBUTION
\r
1280 The code released under the CDDL shall be governed by the laws of the
\r
1281 State of California (excluding conflict-of-law provisions). Any
\r
1282 litigation relating to this License shall be subject to the jurisdiction
\r
1283 of the Federal Courts of the Northern District of California and the
\r
1284 state courts of the State of California, with venue lying in Santa Clara
\r
1285 County, California.

\r
1292 Everyone is permitted to copy and distribute verbatim copies of this
\r
1293 license document, but changing it is not allowed.
\r
1297 The licenses for most software are designed to take away your freedom to
\r
1298 share and change it. By contrast, the GNU General Public License is
\r
1299 intended to guarantee your freedom to share and change free software--to
\r
1300 make sure the software is free for all its users. This General Public
\r
1301 License applies to most of the Free Software Foundation's software and
\r
1302 to any other program whose authors commit to using it. (Some other Free
\r
1303 Software Foundation software is covered by the GNU Library General
\r
1304 Public License instead.) You can apply it to your programs, too.
\r
1306 When we speak of free software, we are referring to freedom, not price.
\r
1307 Our General Public Licenses are designed to make sure that you have the
\r
1308 freedom to distribute copies of free software (and charge for this
\r
1309 service if you wish), that you receive source code or can get it if you
\r
1310 want it, that you can change the software or use pieces of it in new
\r
1311 free programs; and that you know you can do these things.
\r
1313 To protect your rights, we need to make restrictions that forbid anyone
\r
1314 to deny you these rights or to ask you to surrender the rights. These
\r
1315 restrictions translate to certain responsibilities for you if you
\r
1316 distribute copies of the software, or if you modify it.
\r
1318 For example, if you distribute copies of such a program, whether gratis
\r
1319 or for a fee, you must give the recipients all the rights that you have.
\r
1320 You must make sure that they, too, receive or can get the source code.
\r
1321 And you must show them these terms so they know their rights.
\r
1323 We protect your rights with two steps: (1) copyright the software, and
\r
1324 (2) offer you this license which gives you legal permission to copy,
\r
1325 distribute and/or modify the software.
\r
1327 Also, for each author's protection and ours, we want to make certain
\r
1328 that everyone understands that there is no warranty for this free
\r
1329 software. If the software is modified by someone else and passed on, we
\r
1330 want its recipients to know that what they have is not the original, so
\r
1331 that any problems introduced by others will not reflect on the original
\r
1332 authors' reputations.
\r
1334 Finally, any free program is threatened constantly by software patents.
\r
1335 We wish to avoid the danger that redistributors of a free program will
\r
1336 individually obtain patent licenses, in effect making the program
\r
1337 proprietary. To prevent this, we have made it clear that any patent must
\r
1338 be licensed for everyone's free use or not licensed at all.
\r
1340 The precise terms and conditions for copying, distribution and
\r
1341 modification follow.
\r
1343 TERMS AND CONDITIONS FOR COPYING, DISTRIBUTION AND MODIFICATION
\r
1345 0. This License applies to any program or other work which contains a
\r
1346 notice placed by the copyright holder saying it may be distributed under
\r
1347 the terms of this General Public License. The "Program", below, refers
\r
1348 to any such program or work, and a "work based on the Program" means
\r
1349 either the Program or any derivative work under copyright law: that is
\r
1350 to say, a work containing the Program or a portion of it, either
\r
1351 verbatim or with modifications and/or translated into another language.
\r
1352 (Hereinafter, translation is included without limitation in the term
\r
1353 "modification".) Each licensee is addressed as "you".
\r
1355 Activities other than copying, distribution and modification are not
\r
1356 covered by this License; they are outside its scope. The act of running
\r
1357 the Program is not restricted, and the output from the Program is
\r
1358 covered only if its contents constitute a work based on the Program
\r
1359 (independent of having been made by running the Program). Whether that
\r
1360 is true depends on what the Program does.
\r
1362 1. You may copy and distribute verbatim copies of the Program's source
\r
1363 code as you receive it, in any medium, provided that you conspicuously
\r
1364 and appropriately publish on each copy an appropriate copyright notice
\r
1365 and disclaimer of warranty; keep intact all the notices that refer to
\r
1366 this License and to the absence of any warranty; and give any other
\r
1367 recipients of the Program a copy of this License along with the Program.
\r
1369 You may charge a fee for the physical act of transferring a copy, and
\r
1370 you may at your option offer warranty protection in exchange for a fee.
\r
1372 2. You may modify your copy or copies of the Program or any portion of
\r
1373 it, thus forming a work based on the Program, and copy and distribute
\r
1374 such modifications or work under the terms of Section 1 above, provided
\r
1375 that you also meet all of these conditions:
\r
1377 a) You must cause the modified files to carry prominent notices stating
\r
1378 that you changed the files and the date of any change.
\r
1380 b) You must cause any work that you distribute or publish, that in whole
\r
1381 or in part contains or is derived from the Program or any part thereof,
\r
1382 to be licensed as a whole at no charge to all third parties under the
\r
1383 terms of this License.
\r
1385 c) If the modified program normally reads commands interactively when
\r
1386 run, you must cause it, when started running for such interactive use in
\r
1387 the most ordinary way, to print or display an announcement including an
\r
1388 appropriate copyright notice and a notice that there is no warranty (or
\r
1389 else, saying that you provide a warranty) and that users may
\r
1390 redistribute the program under these conditions, and telling the user
\r
1391 how to view a copy of this License. (Exception: if the Program itself is
\r
1392 interactive but does not normally print such an announcement, your work
\r
1393 based on the Program is not required to print an announcement.)
\r
1395 These requirements apply to the modified work as a whole. If
\r
1396 identifiable sections of that work are not derived from the Program, and
\r
1397 can be reasonably considered independent and separate works in
\r
1398 themselves, then this License, and its terms, do not apply to those
\r
1399 sections when you distribute them as separate works. But when you
\r
1400 distribute the same sections as part of a whole which is a work based on
\r
1401 the Program, the distribution of the whole must be on the terms of this
\r
1402 License, whose permissions for other licensees extend to the entire
\r
1403 whole, and thus to each and every part regardless of who wrote it.
\r
1405 Thus, it is not the intent of this section to claim rights or contest
\r
1406 your rights to work written entirely by you; rather, the intent is to
\r
1407 exercise the right to control the distribution of derivative or
\r
1408 collective works based on the Program.
\r
1410 In addition, mere aggregation of another work not based on the Program
\r
1411 with the Program (or with a work based on the Program) on a volume of a
\r
1412 storage or distribution medium does not bring the other work under the
\r
1413 scope of this License.
\r
1415 3. You may copy and distribute the Program (or a work based on it, under
\r
1416 Section 2) in object code or executable form under the terms of Sections
\r
1417 1 and 2 above provided that you also do one of the following:
\r
1419 a) Accompany it with the complete corresponding machine-readable source
\r
1420 code, which must be distributed under the terms of Sections 1 and 2
\r
1421 above on a medium customarily used for software interchange; or,
\r
1423 b) Accompany it with a written offer, valid for at least three years, to
\r
1424 give any third party, for a charge no more than your cost of physically
\r
1425 performing source distribution, a complete machine-readable copy of the
\r
1426 corresponding source code, to be distributed under the terms of Sections
\r
1427 1 and 2 above on a medium customarily used for software interchange; or,
\r
1429 c) Accompany it with the information you received as to the offer to
\r
1430 distribute corresponding source code. (This alternative is allowed only
\r
1431 for noncommercial distribution and only if you received the program in
\r
1432 object code or executable form with such an offer, in accord with
\r
1433 Subsection b above.)
\r
1435 The source code for a work means the preferred form of the work for
\r
1436 making modifications to it. For an executable work, complete source code
\r
1437 means all the source code for all modules it contains, plus any
\r
1438 associated interface definition files, plus the scripts used to control
\r
1439 compilation and installation of the executable. However, as a special
\r
1440 exception, the source code distributed need not include anything that is
\r
1441 normally distributed (in either source or binary form) with the major
\r
1442 components (compiler, kernel, and so on) of the operating system on
\r
1443 which the executable runs, unless that component itself accompanies the
\r
1446 If distribution of executable or object code is made by offering access
\r
1447 to copy from a designated place, then offering equivalent access to copy
\r
1448 the source code from the same place counts as distribution of the source
\r
1449 code, even though third parties are not compelled to copy the source
\r
1450 along with the object code.
\r
1452 4. You may not copy, modify, sublicense, or distribute the Program
\r
1453 except as expressly provided under this License. Any attempt otherwise
\r
1454 to copy, modify, sublicense or distribute the Program is void, and will
\r
1455 automatically terminate your rights under this License. However, parties
\r
1456 who have received copies, or rights, from you under this License will
\r
1457 not have their licenses terminated so long as such parties remain in
\r
1460 5. You are not required to accept this License, since you have not
\r
1461 signed it. However, nothing else grants you permission to modify or
\r
1462 distribute the Program or its derivative works. These actions are
\r
1463 prohibited by law if you do not accept this License. Therefore, by
\r
1464 modifying or distributing the Program (or any work based on the
\r
1465 Program), you indicate your acceptance of this License to do so, and all
\r
1466 its terms and conditions for copying, distributing or modifying the
\r
1467 Program or works based on it.
\r
1469 6. Each time you redistribute the Program (or any work based on the
\r
1470 Program), the recipient automatically receives a license from the
\r
1471 original licensor to copy, distribute or modify the Program subject to
\r
1472 these terms and conditions. You may not impose any further restrictions
\r
1473 on the recipients' exercise of the rights granted herein. You are not
\r
1474 responsible for enforcing compliance by third parties to this License.
\r
1476 7. If, as a consequence of a court judgment or allegation of patent
\r
1477 infringement or for any other reason (not limited to patent issues),
\r
1478 conditions are imposed on you (whether by court order, agreement or
\r
1479 otherwise) that contradict the conditions of this License, they do not
\r
1480 excuse you from the conditions of this License. If you cannot distribute
\r
1481 so as to satisfy simultaneously your obligations under this License and
\r
1482 any other pertinent obligations, then as a consequence you may not
\r
1483 distribute the Program at all. For example, if a patent license would
\r
1484 not permit royalty-free redistribution of the Program by all those who
\r
1485 receive copies directly or indirectly through you, then the only way you
\r
1486 could satisfy both it and this License would be to refrain entirely from
\r
1487 distribution of the Program.
\r
1489 If any portion of this section is held invalid or unenforceable under
\r
1490 any particular circumstance, the balance of the section is intended to
\r
1491 apply and the section as a whole is intended to apply in other
\r
1494 It is not the purpose of this section to induce you to infringe any
\r
1495 patents or other property right claims or to contest validity of any
\r
1496 such claims; this section has the sole purpose of protecting the
\r
1497 integrity of the free software distribution system, which is implemented
\r
1498 by public license practices. Many people have made generous
\r
1499 contributions to the wide range of software distributed through that
\r
1500 system in reliance on consistent application of that system; it is up to
\r
1501 the author/donor to decide if he or she is willing to distribute
\r
1502 software through any other system and a licensee cannot impose that
\r
1505 This section is intended to make thoroughly clear what is believed to be
\r
1506 a consequence of the rest of this License.
\r
1508 8. If the distribution and/or use of the Program is restricted in
\r
1509 certain countries either by patents or by copyrighted interfaces, the
\r
1510 original copyright holder who places the Program under this License may
\r
1511 add an explicit geographical distribution limitation excluding those
\r
1512 countries, so that distribution is permitted only in or among countries
\r
1513 not thus excluded. In such case, this License incorporates the
\r
1514 limitation as if written in the body of this License.
\r
1516 9. The Free Software Foundation may publish revised and/or new versions
\r
1517 of the General Public License from time to time. Such new versions will
\r
1518 be similar in spirit to the present version, but may differ in detail to
\r
1519 address new problems or concerns.
\r
1521 Each version is given a distinguishing version number. If the Program
\r
1522 specifies a version number of this License which applies to it and "any
\r
1523 later version", you have the option of following the terms and
\r
1524 conditions either of that version or of any later version published by
\r
1525 the Free Software Foundation. If the Program does not specify a version
\r
1526 number of this License, you may choose any version ever published by the
\r
1527 Free Software Foundation.
\r
1529 10. If you wish to incorporate parts of the Program into other free
\r
1530 programs whose distribution conditions are different, write to the
\r
1531 author to ask for permission. For software which is copyrighted by the
\r
1532 Free Software Foundation, write to the Free Software Foundation; we
\r
1533 sometimes make exceptions for this. Our decision will be guided by the
\r
1534 two goals of preserving the free status of all derivatives of our free
\r
1535 software and of promoting the sharing and reuse of software generally.
\r
1539 11. BECAUSE THE PROGRAM IS LICENSED FREE OF CHARGE, THERE IS NO WARRANTY
\r
1540 FOR THE PROGRAM, TO THE EXTENT PERMITTED BY APPLICABLE LAW. EXCEPT WHEN
\r
1541 OTHERWISE STATED IN WRITING THE COPYRIGHT HOLDERS AND/OR OTHER PARTIES
\r
1542 PROVIDE THE PROGRAM "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER
\r
1543 EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED
\r
1544 WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE
\r
1545 ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE PROGRAM IS WITH
\r
1546 YOU. SHOULD THE PROGRAM PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL
\r
1547 NECESSARY SERVICING, REPAIR OR CORRECTION.
\r
1549 12. IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW OR AGREED TO IN
\r
1550 WRITING WILL ANY COPYRIGHT HOLDER, OR ANY OTHER PARTY WHO MAY MODIFY
\r
1551 AND/OR REDISTRIBUTE THE PROGRAM AS PERMITTED ABOVE, BE LIABLE TO YOU FOR
\r
1552 DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL
\r
1553 DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE PROGRAM
\r
1554 (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED
\r
1555 INACCURATE OR LOSSES SUSTAINED BY YOU OR THIRD PARTIES OR A FAILURE OF
\r
1556 THE PROGRAM TO OPERATE WITH ANY OTHER PROGRAMS), EVEN IF SUCH HOLDER OR
\r
1557 OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
\r
1559 END OF TERMS AND CONDITIONS
\r
1561 How to Apply These Terms to Your New Programs
\r
1563 If you develop a new program, and you want it to be of the greatest
\r
1564 possible use to the public, the best way to achieve this is to make it
\r
1565 free software which everyone can redistribute and change under these
\r
1568 To do so, attach the following notices to the program. It is safest to
\r
1569 attach them to the start of each source file to most effectively convey
\r
1570 the exclusion of warranty; and each file should have at least the
\r
1571 "copyright" line and a pointer to where the full notice is found.
\r
1573 One line to give the program's name and a brief idea of what it does.
\r
1574 Copyright (C) <year> <name of author>
\r
1576 This program is free software; you can redistribute it and/or modify it
\r
1577 under the terms of the GNU General Public License as published by the
\r
1578 Free Software Foundation; either version 2 of the License, or (at your
\r
1579 option) any later version.
\r
1581 This program is distributed in the hope that it will be useful, but
\r
1582 WITHOUT ANY WARRANTY; without even the implied warranty of
\r
1583 MERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE. See the GNU General
\r
1584 Public License for more details.
\r
1586 You should have received a copy of the GNU General Public License along
\r
1587 with this program; if not, write to the Free Software Foundation, Inc.,
\r
1588 59 Temple Place, Suite 330, Boston, MA 02111-1307 USA
\r
1590 Also add information on how to contact you by electronic and paper mail.
\r
1592 If the program is interactive, make it output a short notice like this
\r
1593 when it starts in an interactive mode:
\r
1595 Gnomovision version 69, Copyright (C) year name of author Gnomovision
\r
1596 comes with ABSOLUTELY NO WARRANTY; for details type `show w'. This is
\r
1597 free software, and you are welcome to redistribute it under certain
\r
1598 conditions; type `show c' for details.
\r
1600 The hypothetical commands `show w' and `show c' should show the
\r
1601 appropriate parts of the General Public License. Of course, the commands
\r
1602 you use may be called something other than `show w' and `show c'; they
\r
1603 could even be mouse-clicks or menu items--whatever suits your program.
\r
1605 You should also get your employer (if you work as a programmer) or your
\r
1606 school, if any, to sign a "copyright disclaimer" for the program, if
\r
1607 necessary. Here is a sample; alter the names:
\r
1609 Yoyodyne, Inc., hereby disclaims all copyright interest in the program
\r
1610 `Gnomovision' (which makes passes at compilers) written by James Hacker.
\r
1612 signature of Ty Coon, 1 April 1989
\r
1613 Ty Coon, President of Vice
\r
1615 This General Public License does not permit incorporating your program
\r
1616 into proprietary programs. If your program is a subroutine library, you
\r
1617 may consider it more useful to permit linking proprietary applications
\r
1618 with the library. If this is what you want to do, use the GNU Library
\r
1619 General Public License instead of this License.
\r
1623 Certain source files distributed by Oracle America, Inc. and/or its
\r
1624 affiliates are subject to the following clarification and special
\r
1625 exception to the GPLv2, based on the GNU Project exception for its
\r
1626 Classpath libraries, known as the GNU Classpath Exception, but only
\r
1627 where Oracle has expressly included in the particular source file's
\r
1628 header the words "Oracle designates this particular file as subject to
\r
1629 the "Classpath" exception as provided by Oracle in the LICENSE file
\r
1630 that accompanied this code."
\r
1632 You should also note that Oracle includes multiple, independent
\r
1633 programs in this software package. Some of those programs are provided
\r
1634 under licenses deemed incompatible with the GPLv2 by the Free Software
\r
1635 Foundation and others. For example, the package includes programs
\r
1636 licensed under the Apache License, Version 2.0. Such programs are
\r
1637 licensed to you under their original licenses.
\r
1639 Oracle facilitates your further distribution of this package by adding
\r
1640 the Classpath Exception to the necessary parts of its GPLv2 code, which
\r
1641 permits you to use that code in combination with other independent
\r
1642 modules not licensed under the GPLv2. However, note that this would
\r
1643 not permit you to commingle code under an incompatible license with
\r
1644 Oracle's GPLv2 licensed code by, for example, cutting and pasting such
\r
1645 code into a file also containing Oracle's GPLv2 licensed code and then
\r
1646 distributing the result. Additionally, if you were to remove the
\r
1647 Classpath Exception from any of the files to which it applies and
\r
1648 distribute the result, you would likely be required to license some or
\r
1649 all of the other code in that distribution under the GPLv2 as well, and
\r
1650 since the GPLv2 is incompatible with the license terms of some items
\r
1651 included in the distribution by Oracle, removing the Classpath
\r
1652 Exception could therefore effectively compromise your ability to
\r
1653 further distribute the package.
\r
1655 Proceed with caution and we recommend that you obtain the advice of a
\r
1656 lawyer skilled in open source matters before removing the Classpath
\r
1657 Exception or making modifications to this package which may
\r
1658 subsequently be redistributed and/or involve the use of third party
\r
1661 CLASSPATH EXCEPTION
\r
1662 Linking this library statically or dynamically with other modules is
\r
1663 making a combined work based on this library. Thus, the terms and
\r
1664 conditions of the GNU General Public License version 2 cover the whole
\r
1667 As a special exception, the copyright holders of this library give you
\r
1668 permission to link this library with independent modules to produce an
\r
1669 executable, regardless of the license terms of these independent
\r
1670 modules, and to copy and distribute the resulting executable under
\r
1671 terms of your choice, provided that you also meet, for each linked
\r
1672 independent module, the terms and conditions of the license of that
\r
1673 module. An independent module is a module which is not derived from or
\r
1674 based on this library. If you modify this library, you may extend this
\r
1675 exception to your version of the library, but you are not obligated to
\r
1676 do so. If you do not wish to do so, delete this exception statement
\r
1677 from your version.

\r
1704 <p>a. <b>"Collective Work"</b> means a work, such as a periodical issue,
\r
1705 anthology or encyclopedia, in which the Work in its entirety in
\r
1706 unmodified form, along with a number of other contributions,
\r
1707 constituting separate and independent works in themselves, are assembled

\r
1711 </p><p>b. <b>"Derivative Work"</b> means a work based upon the Work or
\r
1712 upon the Work and other pre-existing works, such as a translation,
\r
1713 musical arrangement, dramatization, fictionalization, motion picture
\r
1714 version, sound recording, art reproduction, abridgment, condensation, or
\r
1715 any other form in which the Work may be recast, transformed, or
\r
1716 adapted, except that a work that constitutes a Collective Work will not
\r
1717 be considered a Derivative Work for the purpose of this License. For the
\r
1718 avoidance of doubt, where the Work is a musical composition or sound
\r
1719 recording, the synchronization of the Work in timed-relation with a
\r
1720 moving image ("synching") will be considered a Derivative Work for the

\r
1784 <p>a. You may distribute, publicly display, publicly perform, or
\r
1785 publicly digitally perform the Work only under the terms of this
\r
1786 License, and You must include a copy of, or the Uniform Resource

1790 that alter or restrict the terms of this License or the recipients'
\r
1791 exercise of the rights granted hereunder. You may not sublicense the

1792 Work. You must keep intact all notices that refer to this License and to
\r
1793 the disclaimer of warranties. You may not distribute, publicly display,
\r
1794 publicly perform, or publicly digitally perform the Work with any
\r
1795 technological measures that control access or use of the Work in a
\r
1796 manner inconsistent with the terms of this License Agreement. The above
\r
1797 applies to the Work as incorporated in a Collective Work, but this does
\r
1798 not require the Collective Work apart from the Work itself to be made
\r
1799 subject to the terms of this License. If You create a Collective Work,
\r
1800 upon notice from any Licensor You must, to the extent practicable,
\r
1801 remove from the Collective Work any credit as required by clause 4(b),
\r
1802 as requested. If You create a Derivative Work, upon notice from any

\r
1822 provided, however, that in the case of a Derivative Work or Collective

1843 </p><p>7. Termination
\r
1846 <p>a. This License and the rights granted hereunder will terminate
\r
1847 automatically upon any breach by You of the terms of this License.
\r
1848 Individuals or entities who have received Derivative Works or Collective
\r
1849 Works from You under this License, however, will not have their
\r
1850 licenses terminated provided such individuals or entities remain in full

1852 survive any termination of this License.
\r
1853 </p><p>b. Subject to the above terms and conditions, the license granted

\r
1856 the Work under different license terms or to stop distributing the Work
\r
1857 at any time; provided, however that any such election will not serve to
\r
1858 withdraw this License (or any other license that has been, or is
\r
1859 required to be, granted under the terms of this License), and this
\r
1860 License will continue in full force and effect unless terminated as
\r
1864 <p>8. Miscellaneous
\r
1867 <p>a. Each time You distribute or publicly digitally perform the Work or
\r
1868 a Collective Work, the Licensor offers to the recipient a license to
\r
1869 the Work on the same terms and conditions as the license granted to You
\r
1870 under this License.
\r
1871 </p><p>b. Each time You distribute or publicly digitally perform a
\r
1872 Derivative Work, Licensor offers to the recipient a license to the
\r
1873 original Work on the same terms and conditions as the license granted to
\r
1874 You under this License.
\r
1875 </p><p>c. If any provision of this License is invalid or unenforceable

1876 under applicable law, it shall not affect the validity or enforceability

1894 <p>Creative Commons is not a party to this License, and makes no

\r
1918 </p><p><b>1. DEFINITIONS</b>
\r
1919 </p><p>"Contribution" means:
\r
1920 </p><p>a) in the case of the initial Contributor, the initial code and documentation distributed under this Agreement, and
\r
1921 </p><p>b) in the case of each subsequent Contributor:
\r
1922 </p><p>i) changes to the Program, and
\r
1923 </p><p>ii) additions to the Program;
\r
1924 </p><p>where such changes and/or additions to the Program originate from
\r
1925 and are distributed by that particular Contributor. A Contribution
\r
1926 'originates' from a Contributor if it was added to the Program by such
\r
1927 Contributor itself or anyone acting on such Contributor's behalf.
\r
1928 Contributions do not include additions to the Program which: (i) are
\r
1929 separate modules of software distributed in conjunction with the Program
\r
1930 under their own license agreement, and (ii) are not derivative works of
\r
1932 </p><p>"Contributor" means any person or entity that distributes the Program.
\r
1933 </p><p>"Licensed Patents" mean patent claims licensable by a Contributor
\r
1934 which are necessarily infringed by the use or sale of its Contribution
\r
1935 alone or when combined with the Program.
\r
1936 </p><p>"Program" means the Contributions distributed in accordance with this Agreement.
\r
1937 </p><p>"Recipient" means anyone who receives the Program under this Agreement, including all Contributors.
\r
1938 </p><p><b>2. GRANT OF RIGHTS</b>
\r
1939 </p><p>a) Subject to the terms of this Agreement, each Contributor
\r
1940 hereby grants Recipient a non-exclusive, worldwide, royalty-free
\r
1941 copyright license to reproduce, prepare derivative works of, publicly
\r
1942 display, publicly perform, distribute and sublicense the Contribution of
\r
1943 such Contributor, if any, and such derivative works, in source code and
\r
1945 </p><p>b) Subject to the terms of this Agreement, each Contributor
\r
1946 hereby grants Recipient a non-exclusive, worldwide, royalty-free patent
\r
1947 license under Licensed Patents to make, use, sell, offer to sell, import
\r
1948 and otherwise transfer the Contribution of such Contributor, if any, in
\r
1949 source code and object code form. This patent license shall apply to
\r
1950 the combination of the Contribution and the Program if, at the time the
\r
1951 Contribution is added by the Contributor, such addition of the
\r
1952 Contribution causes such combination to be covered by the Licensed
\r
1953 Patents. The patent license shall not apply to any other combinations
\r
1954 which include the Contribution. No hardware per se is licensed
\r
1956 </p><p>c) Recipient understands that although each Contributor grants
\r
1957 the licenses to its Contributions set forth herein, no assurances are
\r
1958 provided by any Contributor that the Program does not infringe the
\r
1959 patent or other intellectual property rights of any other entity. Each
\r
1960 Contributor disclaims any liability to Recipient for claims brought by
\r
1961 any other entity based on infringement of intellectual property rights
\r
1962 or otherwise. As a condition to exercising the rights and licenses
\r
1963 granted hereunder, each Recipient hereby assumes sole responsibility to
\r
1964 secure any other intellectual property rights needed, if any. For
\r
1965 example, if a third party patent license is required to allow Recipient
\r
1966 to distribute the Program, it is Recipient's responsibility to acquire
\r
1967 that license before distributing the Program.
\r
1968 </p><p>d) Each Contributor represents that to its knowledge it has
\r
1969 sufficient copyright rights in its Contribution, if any, to grant the
\r
1970 copyright license set forth in this Agreement.
\r
1971 </p><p><b>3. REQUIREMENTS</b>
\r
1972 </p><p>A Contributor may choose to distribute the Program in object code form under its own license agreement, provided that:
\r
1973 </p><p>a) it complies with the terms and conditions of this Agreement; and
\r
1974 </p><p>b) its license agreement:
\r
1975 </p><p>i) effectively disclaims on behalf of all Contributors all
\r
1976 warranties and conditions, express and implied, including warranties or
\r
1977 conditions of title and non-infringement, and implied warranties or
\r
1978 conditions of merchantability and fitness for a particular purpose;
\r
1979 </p><p>ii) effectively excludes on behalf of all Contributors all
\r
1980 liability for damages, including direct, indirect, special, incidental
\r
1981 and consequential damages, such as lost profits;
\r
1982 </p><p>iii) states that any provisions which differ from this Agreement
\r
1983 are offered by that Contributor alone and not by any other party; and
\r
1984 </p><p>iv) states that source code for the Program is available from
\r
1985 such Contributor, and informs licensees how to obtain it in a reasonable
\r
1986 manner on or through a medium customarily used for software exchange.
\r
1987 </p><p>When the Program is made available in source code form:
\r
1988 </p><p>a) it must be made available under this Agreement; and
\r
1989 </p><p>b) a copy of this Agreement must be included with each copy of the Program.
\r
1990 </p><p>Contributors may not remove or alter any copyright notices contained within the Program.
\r
1991 </p><p>Each Contributor must identify itself as the originator of its
\r
1992 Contribution, if any, in a manner that reasonably allows subsequent
\r
1993 Recipients to identify the originator of the Contribution.
\r
1994 </p><p><b>4. COMMERCIAL DISTRIBUTION</b>
\r
1995 </p><p>Commercial distributors of software may accept certain
\r
1996 responsibilities with respect to end users, business partners and the
\r
1997 like. While this license is intended to facilitate the commercial use of
\r
1998 the Program, the Contributor who includes the Program in a commercial
\r
1999 product offering should do so in a manner which does not create
\r
2000 potential liability for other Contributors. Therefore, if a Contributor
\r
2001 includes the Program in a commercial product offering, such Contributor
\r
2002 ("Commercial Contributor") hereby agrees to defend and indemnify every
\r
2003 other Contributor ("Indemnified Contributor") against any losses,
\r
2004 damages and costs (collectively "Losses") arising from claims, lawsuits
\r
2005 and other legal actions brought by a third party against the Indemnified
\r
2006 Contributor to the extent caused by the acts or omissions of such
\r
2007 Commercial Contributor in connection with its distribution of the
\r
2008 Program in a commercial product offering. The obligations in this
\r
2009 section do not apply to any claims or Losses relating to any actual or
\r
2010 alleged intellectual property infringement. In order to qualify, an
\r
2011 Indemnified Contributor must: a) promptly notify the Commercial
\r
2012 Contributor in writing of such claim, and b) allow the Commercial
\r
2013 Contributor to control, and cooperate with the Commercial Contributor
\r
2014 in, the defense and any related settlement negotiations. The Indemnified
\r
2015 Contributor may participate in any such claim at its own expense.
\r
2016 </p><p>For example, a Contributor might include the Program in a
\r
2017 commercial product offering, Product X. That Contributor is then a
\r
2018 Commercial Contributor. If that Commercial Contributor then makes
\r
2019 performance claims, or offers warranties related to Product X, those
\r
2020 performance claims and warranties are such Commercial Contributor's
\r
2021 responsibility alone. Under this section, the Commercial Contributor
\r
2022 would have to defend claims against the other Contributors related to
\r
2023 those performance claims and warranties, and if a court requires any
\r
2024 other Contributor to pay any damages as a result, the Commercial
\r
2025 Contributor must pay those damages.
\r
2026 </p><p><b>5. NO WARRANTY</b>
\r
2027 </p><p>EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, THE PROGRAM IS
\r
2028 PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY
\r
2029 KIND, EITHER EXPRESS OR IMPLIED INCLUDING, WITHOUT LIMITATION, ANY
\r
2030 WARRANTIES OR CONDITIONS OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR
\r
2031 FITNESS FOR A PARTICULAR PURPOSE. Each Recipient is solely responsible
\r
2032 for determining the appropriateness of using and distributing the
\r
2033 Program and assumes all risks associated with its exercise of rights
\r
2034 under this Agreement , including but not limited to the risks and costs
\r
2035 of program errors, compliance with applicable laws, damage to or loss of
\r
2036 data, programs or equipment, and unavailability or interruption of
\r
2038 </p><p><b>6. DISCLAIMER OF LIABILITY</b>
\r
2039 </p><p>EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, NEITHER
\r
2040 RECIPIENT NOR ANY CONTRIBUTORS SHALL HAVE ANY LIABILITY FOR ANY DIRECT,
\r
2041 INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES
\r
2042 (INCLUDING WITHOUT LIMITATION LOST PROFITS), HOWEVER CAUSED AND ON ANY
\r
2043 THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT
\r
2044 (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OR
\r
2045 DISTRIBUTION OF THE PROGRAM OR THE EXERCISE OF ANY RIGHTS GRANTED
\r
2046 HEREUNDER, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
\r
2047 </p><p><b>7. GENERAL</b>
\r
2048 </p><p>If any provision of this Agreement is invalid or unenforceable
\r
2049 under applicable law, it shall not affect the validity or enforceability
\r
2050 of the remainder of the terms of this Agreement, and without further
\r
2051 action by the parties hereto, such provision shall be reformed to the
\r
2052 minimum extent necessary to make such provision valid and enforceable.
\r
2053 </p><p>If Recipient institutes patent litigation against any entity
\r
2054 (including a cross-claim or counterclaim in a lawsuit) alleging that the
\r
2055 Program itself (excluding combinations of the Program with other
\r
2056 software or hardware) infringes such Recipient's patent(s), then such
\r
2057 Recipient's rights granted under Section 2(b) shall terminate as of the
\r
2058 date such litigation is filed.
\r
2059 </p><p>All Recipient's rights under this Agreement shall terminate if it
\r
2060 fails to comply with any of the material terms or conditions of this
\r
2061 Agreement and does not cure such failure in a reasonable period of time
\r
2062 after becoming aware of such noncompliance. If all Recipient's rights
\r
2063 under this Agreement terminate, Recipient agrees to cease use and
\r
2064 distribution of the Program as soon as reasonably practicable. However,
\r
2065 Recipient's obligations under this Agreement and any licenses granted by
\r
2066 Recipient relating to the Program shall continue and survive.
\r
2067 </p><p>Everyone is permitted to copy and distribute copies of this
\r
2068 Agreement, but in order to avoid inconsistency the Agreement is
\r
2069 copyrighted and may only be modified in the following manner. The
\r
2070 Agreement Steward reserves the right to publish new versions (including
\r
2071 revisions) of this Agreement from time to time. No one other than the
\r
2072 Agreement Steward has the right to modify this Agreement. The Eclipse
\r
2073 Foundation is the initial Agreement Steward. The Eclipse Foundation may
\r
2074 assign the responsibility to serve as the Agreement Steward to a
\r
2075 suitable separate entity. Each new version of the Agreement will be
\r
2076 given a distinguishing version number. The Program (including
\r
2077 Contributions) may always be distributed subject to the version of the
\r
2078 Agreement under which it was received. In addition, after a new version
\r
2079 of the Agreement is published, Contributor may elect to distribute the
\r
2080 Program (including its Contributions) under the new version. Except as
\r
2081 expressly stated in Sections 2(a) and 2(b) above, Recipient receives no
\r
2082 rights or licenses to the intellectual property of any Contributor under
\r
2083 this Agreement, whether expressly, by implication, estoppel or
\r
2084 otherwise. All rights in the Program not expressly granted under this
\r
2085 Agreement are reserved.
\r
2086 </p><p>This Agreement is governed by the laws of the State of New York
\r
2087 and the intellectual property laws of the United States of America. No
\r
2088 party to this Agreement will bring a legal action under this Agreement
\r
2089 more than one year after the cause of action arose. Each party waives
\r
2090 its rights to a jury trial in any resulting litigation.

2229 incorporates the terms and conditions of version 3 of the GNU General
\r
2230 Public License, supplemented by the additional permissions listed below.
\r
2231 </p><p><b>0. Additional Definitions.</b>
\r
2232 </p><p>As used herein, “this License” refers to version 3 of the GNU
\r
2233 Lesser General Public License, and the “GNU GPL” refers to version 3 of
\r
2234 the GNU General Public License.
\r
2235 </p><p>“The Library” refers to a covered work governed by this License, other than an Application or a Combined Work as defined below.
\r
2236 </p><p>An “Application” is any work that makes use of an interface
\r
2237 provided by the Library, but which is not otherwise based on the
\r
2238 Library. Defining a subclass of a class defined by the Library is deemed
\r
2239 a mode of using an interface provided by the Library.
\r
2240 </p><p>A “Combined Work” is a work produced by combining or linking an
\r
2241 Application with the Library. The particular version of the Library with
\r
2242 which the Combined Work was made is also called the “Linked Version”.
\r
2243 </p><p>The “Minimal Corresponding Source” for a Combined Work means the
\r
2244 Corresponding Source for the Combined Work, excluding any source code
\r
2245 for portions of the Combined Work that, considered in isolation, are
\r
2246 based on the Application, and not on the Linked Version.
\r
2247 </p><p>The “Corresponding Application Code” for a Combined Work means
\r
2248 the object code and/or source code for the Application, including any

\r
2253 </p><p>You may convey a covered work under sections 3 and 4 of this License without being bound by section 3 of the GNU GPL.
\r
2254 </p><p><b>2. Conveying Modified Versions.</b>
\r
2255 </p><p>If you modify a copy of the Library, and, in your modifications, a
\r
2256 facility refers to a function or data to be supplied by an Application
\r
2257 that uses the facility (other than as an argument passed when the
\r
2258 facility is invoked), then you may convey a copy of the modified
\r
2262 <li> a) under this License, provided that you make a good faith effort
\r
2263 to ensure that, in the event an Application does not supply the function
\r
2264 or data, the facility still operates, and performs whatever part of its
\r
2265 purpose remains meaningful, or
\r
2267 <li> b) under the GNU GPL, with none of the additional permissions of this License applicable to that copy.
\r
2270 <p><b>3. Object Code Incorporating Material from Library Header Files.</b>
\r
2271 </p><p>The object code form of an Application may incorporate material
\r
2272 from a header file that is part of the Library. You may convey such
\r
2273 object code under terms of your choice, provided that, if the
\r
2274 incorporated material is not limited to numerical parameters, data
\r
2275 structure layouts and accessors, or small macros, inline functions and
\r
2276 templates (ten or fewer lines in length), you do both of the following:
\r
2279 <li> a) Give prominent notice with each copy of the object code that the
\r
2280 Library is used in it and that the Library and its use are covered by
\r
2283 <li> b) Accompany the object code with a copy of the GNU GPL and this license document.
\r
2286 <p><b>4. Combined Works.</b>
\r
2287 </p><p>You may convey a Combined Work under terms of your choice that,
\r
2288 taken together, effectively do not restrict modification of the portions
\r
2289 of the Library contained in the Combined Work and reverse engineering
\r
2290 for debugging such modifications, if you also do each of the following:
\r
2293 <li> a) Give prominent notice with each copy of the Combined Work that
\r
2294 the Library is used in it and that the Library and its use are covered
\r
2297 <li> b) Accompany the Combined Work with a copy of the GNU GPL and this license document.
\r
2299 <li> c) For a Combined Work that displays copyright notices during
\r
2300 execution, include the copyright notice for the Library among these
\r
2301 notices, as well as a reference directing the user to the copies of the
\r
2302 GNU GPL and this license document.
\r
2304 <li> d) Do one of the following:
\r
2306 <li> 0) Convey the Minimal Corresponding Source under the terms of this
\r
2307 License, and the Corresponding Application Code in a form suitable for,
\r
2308 and under terms that permit, the user to recombine or relink the
\r
2309 Application with a modified version of the Linked Version to produce a
\r
2310 modified Combined Work, in the manner specified by section 6 of the GNU
\r
2311 GPL for conveying Corresponding Source.
\r
2313 <li> 1) Use a suitable shared library mechanism for linking with the
\r
2314 Library. A suitable mechanism is one that (a) uses at run time a copy of
\r
2315 the Library already present on the user's computer system, and (b) will
\r
2316 operate properly with a modified version of the Library that is
\r
2317 interface-compatible with the Linked Version.
\r
2321 <li> e) Provide Installation Information, but only if you would
\r
2322 otherwise be required to provide such information under section 6 of the
\r
2323 GNU GPL, and only to the extent that such information is necessary to
\r
2324 install and execute a modified version of the Combined Work produced by
\r
2325 recombining or relinking the Application with a modified version of the
\r
2326 Linked Version. (If you use option 4d0, the Installation Information
\r
2327 must accompany the Minimal Corresponding Source and Corresponding
\r
2328 Application Code. If you use option 4d1, you must provide the
\r
2329 Installation Information in the manner specified by section 6 of the GNU
\r
2330 GPL for conveying Corresponding Source.)
\r
2333 <p><b>5. Combined Libraries.</b>
\r
2334 </p><p>You may place library facilities that are a work based on the
\r
2335 Library side by side in a single library together with other library
\r
2336 facilities that are not Applications and are not covered by this
\r
2337 License, and convey such a combined library under terms of your choice,
\r
2338 if you do both of the following:
\r
2341 <li> a) Accompany the combined library with a copy of the same work
\r
2342 based on the Library, uncombined with any other library facilities,
\r
2343 conveyed under the terms of this License.
\r
2345 <li> b) Give prominent notice with the combined library that part of it
\r
2346 is a work based on the Library, and explaining where to find the
\r
2347 accompanying uncombined form of the same work.
\r
2350 <p><b>6. Revised Versions of the GNU Lesser General Public License.</b>
\r
2351 </p><p>The Free Software Foundation may publish revised and/or new
\r
2352 versions of the GNU Lesser General Public License from time to time.
\r
2353 Such new versions will be similar in spirit to the present version, but
\r
2354 may differ in detail to address new problems or concerns.
\r
2355 </p><p>Each version is given a distinguishing version number. If the
\r
2356 Library as you received it specifies that a certain numbered version of
\r
2357 the GNU Lesser General Public License “or any later version” applies to
\r
2358 it, you have the option of following the terms and conditions either of
\r
2359 that published version or of any later version published by the Free
\r
2360 Software Foundation. If the Library as you received it does not specify a
\r
2361 version number of the GNU Lesser General Public License, you may choose
\r
2362 any version of the GNU Lesser General Public License ever published by
\r
2363 the Free Software Foundation.

2479 ownership of such entity.
\r
2481 2. License Grants and Conditions
\r
2482 --------------------------------
\r
2486 Each Contributor hereby grants You a world-wide, royalty-free,
\r
2487 non-exclusive license:
\r
2489 (a) under intellectual property rights (other than patent or trademark)
\r
2490 Licensable by such Contributor to use, reproduce, make available,
\r
2491 modify, display, perform, distribute, and otherwise exploit its
\r
2492 Contributions, either on an unmodified basis, with Modifications, or

2495 (b) under Patent Claims of such Contributor to make, use, sell, offer
\r
2496 for sale, have made, import, and otherwise transfer either its
\r
2497 Contributions or its Contributor Version.
\r
2499 2.2. Effective Date
\r
2501 The licenses granted in Section 2.1 with respect to any Contribution
\r
2502 become effective for each Contribution on the date the Contributor first
\r
2503 distributes such Contribution.
\r
2505 2.3. Limitations on Grant Scope
\r
2507 The licenses granted in this Section 2 are the only rights granted under
\r
2508 this License. No additional rights or licenses will be implied from the
\r
2509 distribution or licensing of Covered Software under this License.
\r
2510 Notwithstanding Section 2.1(b) above, no patent license is granted by a
\r
2513 (a) for any code that a Contributor has removed from Covered Software;
\r
2516 (b) for infringements caused by: (i) Your and any other third party's
\r
2517 modifications of Covered Software, or (ii) the combination of its
\r
2518 Contributions with other software (except as part of its Contributor
\r
2521 (c) under Patent Claims infringed by Covered Software in the absence of
\r
2522 its Contributions.
\r
2524 This License does not grant any rights in the trademarks, service marks,
\r
2525 or logos of any Contributor (except as may be necessary to comply with
\r
2526 the notice requirements in Section 3.4).
\r
2528 2.4. Subsequent Licenses
\r
2530 No Contributor makes additional grants as a result of Your choice to
\r
2531 distribute the Covered Software under a subsequent version of this
\r
2532 License (see Section 10.2) or under the terms of a Secondary License (if
\r
2533 permitted under the terms of Section 3.3).
\r
2535 2.5. Representation
\r
2537 Each Contributor represents that the Contributor believes its
\r
2538 Contributions are its original creation(s) or it has sufficient rights
\r
2539 to grant the rights to its Contributions conveyed by this License.
\r
2543 This License is not intended to limit any rights You have under
\r
2544 applicable copyright doctrines of fair use, fair dealing, or other
\r
2549 Sections 3.1, 3.2, 3.3, and 3.4 are conditions of the licenses granted
\r
2552 3. Responsibilities
\r
2553 -------------------
\r
2555 3.1. Distribution of Source Form
\r
2557 All distribution of Covered Software in Source Code Form, including any
\r
2558 Modifications that You create or to which You contribute, must be under
\r
2559 the terms of this License. You must inform recipients that the Source
\r
2560 Code Form of the Covered Software is governed by the terms of this
\r
2561 License, and how they can obtain a copy of this License. You may not
\r
2562 attempt to alter or restrict the recipients' rights in the Source Code
\r
2565 3.2. Distribution of Executable Form
\r
2567 If You distribute Covered Software in Executable Form then:
\r
2569 (a) such Covered Software must also be made available in Source Code
\r
2570 Form, as described in Section 3.1, and You must inform recipients of
\r
2571 the Executable Form how they can obtain a copy of such Source Code
\r
2572 Form by reasonable means in a timely manner, at a charge no more
\r
2573 than the cost of distribution to the recipient; and
\r
2575 (b) You may distribute such Executable Form under the terms of this
\r
2576 License, or sublicense it under different terms, provided that the
\r
2577 license for the Executable Form does not attempt to limit or alter
\r
2578 the recipients' rights in the Source Code Form under this License.
\r
2580 3.3. Distribution of a Larger Work
\r
2582 You may create and distribute a Larger Work under terms of Your choice,
\r
2583 provided that You also comply with the requirements of this License for
\r
2584 the Covered Software. If the Larger Work is a combination of Covered
\r
2585 Software with a work governed by one or more Secondary Licenses, and the
\r
2586 Covered Software is not Incompatible With Secondary Licenses, this
\r
2587 License permits You to additionally distribute such Covered Software
\r
2588 under the terms of such Secondary License(s), so that the recipient of
\r
2589 the Larger Work may, at their option, further distribute the Covered
\r
2590 Software under the terms of either this License or such Secondary
\r
2595 You may not remove or alter the substance of any license notices
\r
2596 (including copyright notices, patent notices, disclaimers of warranty,
\r
2597 or limitations of liability) contained within the Source Code Form of
\r
2598 the Covered Software, except that You may alter any license notices to
\r
2599 the extent required to remedy known factual inaccuracies.
\r
2601 3.5. Application of Additional Terms
\r
2603 You may choose to offer, and to charge a fee for, warranty, support,
\r
2604 indemnity or liability obligations to one or more recipients of Covered
\r
2605 Software. However, You may do so only on Your own behalf, and not on
\r
2606 behalf of any Contributor. You must make it absolutely clear that any
\r
2607 such warranty, support, indemnity, or liability obligation is offered by
\r
2608 You alone, and You hereby agree to indemnify every Contributor for any
\r
2609 liability incurred by such Contributor as a result of warranty, support,
\r
2610 indemnity or liability terms You offer. You may include additional
\r
2611 disclaimers of warranty and limitations of liability specific to any
\r
2614 4. Inability to Comply Due to Statute or Regulation
\r
2615 ---------------------------------------------------
\r
2617 If it is impossible for You to comply with any of the terms of this
\r
2618 License with respect to some or all of the Covered Software due to
\r
2619 statute, judicial order, or regulation then You must: (a) comply with
\r
2620 the terms of this License to the maximum extent possible; and (b)
\r
2621 describe the limitations and the code they affect. Such description must
\r
2622 be placed in a text file included with all distributions of the Covered
\r
2623 Software under this License. Except to the extent prohibited by statute
\r
2624 or regulation, such description must be sufficiently detailed for a
\r
2625 recipient of ordinary skill to be able to understand it.
\r
2630 5.1. The rights granted under this License will terminate automatically
\r
2631 if You fail to comply with any of its terms. However, if You become
\r
2632 compliant, then the rights granted under this License from a particular
\r
2633 Contributor are reinstated (a) provisionally, unless and until such
\r
2634 Contributor explicitly and finally terminates Your grants, and (b) on an
\r
2635 ongoing basis, if such Contributor fails to notify You of the
\r
2636 non-compliance by some reasonable means prior to 60 days after You have
\r
2637 come back into compliance. Moreover, Your grants from a particular
\r
2638 Contributor are reinstated on an ongoing basis if such Contributor
\r
2639 notifies You of the non-compliance by some reasonable means, this is the
\r
2640 first time You have received notice of non-compliance with this License
\r
2641 from such Contributor, and You become compliant prior to 30 days after
\r
2642 Your receipt of the notice.
\r
2644 5.2. If You initiate litigation against any entity by asserting a patent
\r
2645 infringement claim (excluding declaratory judgment actions,
\r
2646 counter-claims, and cross-claims) alleging that a Contributor Version
\r
2647 directly or indirectly infringes any patent, then the rights granted to
\r
2648 You by any and all Contributors for the Covered Software under Section
\r
2649 2.1 of this License shall terminate.
\r
2651 5.3. In the event of termination under Sections 5.1 or 5.2 above, all
\r
2652 end user license agreements (excluding distributors and resellers) which
\r
2653 have been validly granted by You or Your distributors under this License
\r
2654 prior to termination shall survive termination.
